Legal launch draft
Terms of Service
Important: this document is a product-ready draft for legal review. It should be reviewed by Bulgarian counsel before Sgodno is opened to the public.
1. Who we are
Sgodno is an introduction-only marketplace for home services in Sofia, Bulgaria. Customers can post tasks, and independent taskers can submit bids. If a customer accepts a bid, Sgodno reveals the customer and tasker contact details so they can coordinate directly.
2. Sgodno is not the service provider
The home service agreement is made directly between the customer and the tasker. Sgodno is not a party to that agreement. Sgodno does not perform, supervise, direct, insure, warrant, or guarantee any cleaning, repair, moving, assembly, or other off-platform work.
3. No employment, agency, or partnership
Taskers are independent users of the software. They are not employees, agents, representatives, subcontractors, or partners of Sgodno. Taskers are responsible for their own taxes, permits, invoices, insurance, tools, safety practices, and legal right to perform the work they offer.
4. No verification unless expressly stated
Unless a profile is expressly marked with a specific verification badge, Sgodno does not verify identity, qualifications, criminal history, insurance, licences, professional status, references, or the legal capacity of any user. Customers must decide for themselves whether a tasker is suitable.
5. User responsibilities
Customers are responsible for describing tasks accurately, choosing whom to hire, agreeing scope and price, securing valuables, checking qualifications where relevant, providing safe access, and paying the tasker directly. Taskers are responsible for truthful bids, lawful work, safe conduct, and performing only work they are competent and legally allowed to perform.
6. Trader or private individual status
Taskers must truthfully state whether they act as a business or professional trader, or as a private individual. Consumer rights that apply against a professional trader may not apply in the same way when a customer chooses a private individual. Sgodno does not decide or guarantee a tasker's legal status.
7. Contact sharing consent
By posting a task or submitting a bid, you consent to your phone number being shared with the matched counterparty after a bid is accepted. You may not use contact details obtained through Sgodno for spam, harassment, resale, scraping, unrelated marketing, automated outreach, or any purpose other than coordinating the matched task. Breach of this clause is grounds for immediate suspension and may be reported to the competent authority.
8. Off-platform payments and risk
Sgodno does not process payments, hold escrow, set final prices, issue refunds, or confirm completion. Users meet, coordinate, pay, and perform work at their own risk. Sgodno is not responsible for no-shows, poor workmanship, property damage, theft, injury, payment disputes, tax disputes, employment claims, or any other issue arising from off-platform work.
9. Prohibited use
You must not use Sgodno for illegal, unsafe, discriminatory, fraudulent, sexual, violent, hazardous, regulated, or permit-required work unless all required permits, licences, and safeguards are in place. Sgodno may remove content, cancel tasks or bids, suspend users, or restrict access where we believe there is abuse, fraud, safety risk, legal risk, or harm to platform integrity.
10. User content and reviews
You are responsible for task descriptions, bids, profile text, photos, and reviews you submit. You grant Sgodno a non-exclusive, worldwide, royalty-free licence to host, display, reproduce, and adapt that content as needed to operate, secure, improve, and promote the service. You must not upload content that infringes rights, exposes private information unlawfully, or misleads other users.
11. Availability and changes
Sgodno may change, suspend, restrict, or discontinue any feature at any time. We aim to provide a reliable service, but we do not guarantee uninterrupted availability, error-free operation, or that any task will receive bids.
12. Limitation of liability
To the fullest extent permitted by law, Sgodno and its owner are not liable for indirect, incidental, special, consequential, punitive, or lost-profit damages, or for damages arising from off-platform work between users. To the fullest extent permitted by law, Sgodno's total liability for any claim is limited to the greater of the fees you paid directly to Sgodno in the 12 months before the claim or EUR 50.
13. Indemnity (business users only)
If you use Sgodno in the course of a trade, business, craft, or profession, you agree to indemnify and hold harmless Sgodno, its owner, operators, contractors, and service providers from claims, losses, liabilities, damages, costs, and expenses arising from your content, your task or bid, your off-platform work, your breach of these Terms, your violation of law, tax or employment obligations, or your dispute with another user. This indemnity does not apply to consumers acting outside their trade or profession; consumer rights under EU and Bulgarian law are unaffected.
14. Closing your account
You may close your account at any time from the account settings page. Closure soft-deletes your account and anonymises your name and email; reviews, audit records, and aggregate marketplace data are preserved for platform integrity and may be retained as described in our Privacy Policy. Hard deletion of remaining personal data follows after the retention period.
15. Mandatory rights
Nothing in these Terms excludes or limits liability or consumer rights that cannot lawfully be excluded or limited. If a clause is unenforceable, the rest of these Terms remains effective to the maximum lawful extent.
16. Governing law
These Terms are governed by the laws of Bulgaria, without prejudice to mandatory consumer protections that may apply. Disputes are subject to the competent Bulgarian courts unless mandatory law gives you another forum.
17. Fees
At the time of this draft, Sgodno is free for both customers and taskers. We may introduce fees, subscriptions, or pay-per-acceptance pricing in a future phase; any new fee will be announced in advance and will only apply to activity after the effective date.
